1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the Pummel.ai website, application, and related services (collectively, the “Services”), operated by Pummel (“Pummel,” “we,” “us,” or “our”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

2. Description of Services

Pummel provides an interface that allows users to submit prompts to multiple third-party artificial intelligence models and view the resulting outputs side by side. Pummel may also provide synthesized or comparative outputs based on those responses.

Pummel does not develop, own, or control the underlying AI models. All AI responses are generated by third-party providers.

3. Eligibility and Accounts

You must be at least 13 years of age to use the Services. By creating an account, you represent that you meet this requirement and that the information you provide is accurate and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Subscriptions and Billing

Pummel offers free and paid subscription plans. Paid plans are billed in advance on a recurring monthly basis unless otherwise stated.

• Subscriptions renew automatically unless canceled.
• Pricing and plan features may change with prior notice.
• Payments are processed by Stripe. Pummel does not store full payment card details.
• Except where required by law, subscription fees are non-refundable.

5. Usage Limits and Fair Use

Each plan includes defined usage limits, such as request volume, feature access, and spending caps. These limits are enforced to ensure service stability and fair access.

If you reach a limit, additional requests may be restricted until the next billing period or until you upgrade your plan. Pummel will not charge you beyond your selected plan limits.

6. Acceptable Use

You agree not to misuse the Services, including by:

• Violating applicable laws or regulations
• Attempting to bypass usage limits or safeguards
• Interfering with system performance or security
• Using the Services to generate unlawful or harmful content
• Reselling or redistributing the Services without authorization

7. AI-Generated Content Disclaimer

AI-generated outputs may be inaccurate, incomplete, or biased. You are solely responsible for evaluating and verifying any output before relying on it.

The Services are not intended to provide legal, medical, financial, or other professional advice.

8. Intellectual Property

You retain ownership of your prompts. Pummel retains all rights to its software, branding, and proprietary systems.

AI outputs are subject to the applicable terms of the underlying model providers.

9. Limitation of Liability

To the maximum extent permitted by law, the Services are provided “as is” without warranties of any kind.

Pummel shall not be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amounts paid by you to Pummel in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Pummel from claims arising out of your use of the Services or violation of these Terms.

11. Termination

You may terminate your account at any time. Pummel may suspend or terminate access for violations of these Terms or to protect the integrity of the Services.

12. Dispute Resolution

Any disputes shall be resolved through binding arbitration on an individual basis. Class actions are waived to the extent permitted by law.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
