Terms of Service

Welcome to Pummel.ai ("Pummel," "we," "us," or "our"). By accessing or using our service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use Pummel.

These Terms apply to all users of the service, including free and paid subscribers.

Pummel is an AI comparison platform that allows you to submit prompts to multiple AI providers (currently OpenAI, Anthropic, and Google) and view their responses side-by-side. The service helps you compare AI outputs to make more informed decisions.

We do not create or control the AI models themselves. We provide an interface to access third-party AI services.

To use Pummel, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

You must be at least 13 years old to use Pummel. If you are under 18, you represent that you have your parent or guardian's permission to use the service.

Pummel offers free and paid subscription plans. By subscribing to a paid plan, you agree to the following:

• Billing Cycle: Paid subscriptions are billed monthly in advance.
• Automatic Renewal: Your subscription will automatically renew at the end of each billing period unless you cancel.
• Price Changes: We may change subscription prices with 30 days' notice. Price changes will take effect at your next renewal.
• Refunds: We generally do not provide refunds for partial subscription periods. If you cancel, you will retain access until the end of your current billing period.
• Payment Processing: Payments are processed by Stripe. Your payment information is handled directly by Stripe and is not stored on our servers.

Each subscription tier includes specific usage limits (number of runs, providers per request, and monthly cost caps). These limits are designed to ensure fair use and service sustainability.

When you reach a usage limit, additional requests will be blocked until the limit resets or you upgrade your plan. You will never be charged beyond your subscription fee—our cost caps protect you from unexpected charges.

You agree not to use Pummel to:

• Violate any applicable laws or regulations
• Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Infringe on the intellectual property rights of others
• Attempt to circumvent usage limits or security measures
• Interfere with or disrupt the service or servers
• Use automated systems (bots, scrapers) to access the service without permission
• Resell or redistribute access to the service
• Generate content that violates the acceptable use policies of our AI providers

We reserve the right to suspend or terminate accounts that violate these guidelines.

The responses you receive through Pummel are generated by third-party AI models. You understand and agree that:

• AI-generated content may contain errors, inaccuracies, or biases
• You are responsible for reviewing and verifying any AI output before relying on it
• Pummel does not guarantee the accuracy, completeness, or fitness for any particular purpose of AI responses
• AI responses should not be considered professional advice (legal, medical, financial, etc.)

Your Content: You retain ownership of the prompts you submit. By using Pummel, you grant us a limited license to process your prompts through our service and the AI providers.

AI Outputs: Ownership of AI-generated content varies by provider. Generally, you may use the outputs for your own purposes, subject to each AI provider's terms of service.

Our Service: Pummel, including its design, code, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, or redistribute our service without permission.

To the maximum extent permitted by law:

• Pummel is provided "as is" without warranties of any kind, express or implied.
• We do not warrant that the service will be uninterrupted, error-free, or secure.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
• Our total liability to you for any claims arising from these Terms or your use of Pummel shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold harmless Pummel and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the service or violation of these Terms.

We reserve the right to modify, suspend, or discontinue any part of Pummel at any time, with or without notice. We may also add or remove AI providers, change features, or update pricing. We will make reasonable efforts to notify users of significant changes.

You may cancel your account at any time through your account settings or by contacting us.

We may suspend or terminate your account if you violate these Terms or for any other reason at our discretion. Upon termination, your right to use Pummel will immediately cease.

If you have a dispute with Pummel, we encourage you to contact us first to seek resolution. Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of Pummel after changes are posted constitutes your acceptance of the updated Terms.
